Mobs of blacks attacking and intimidating residents of Mosselbay, West Cape, torching and attacking shops
Today and over the last few days black African mobs weearing the red berets of the Economic Freedom Fighters (party) have been marching through Mosselbay, intimidating residents, destroying traffic lights, setting fires ablaze and people are advised to stay out of the streets. Shopping areas downtown have suffered because the police are unable to control the mob and people stay home.
(Referred to as Flashmobs because the groups are centrally organized by one person with a cellphone and redirected to various locations as needed)
It is said that some Eastern Cape busses have brought some of the people here. http://www.mosselbayadvertiser.com/gallery.aspx?gpid=2867&gid=1&h=Mossel-Bay-riots

Baby-killer still at large: Suspect Themba Ephraim Mahlangu sought for double murder of baby Wiehan Botes 9 mos and carer Magrietha de Goede, 66
SAPS publish identikit of doublemurder-suspect Themba Ephraim Mahlangu, PICTURE) sought for murder of Baby Wiehan Botes and carer Magrietha de Goede, 66, of Delmas on August 21 2012.
BACKGROUND:
Child day-mother Magrietha de Goede 66, and baby Wiehan Botes 9 months, were gruesomely murdered by a man the police have identified as Themba Epharaim Mahlangu, 26. They have three black witnesses in protective custody who have identified him.
The two Afrikaans people were murdered on August 21 2012 in the baby's Delmas home. Another child from another Afrikaans family, 18 months old, was found unharmed. There seems to be no motive for such an excessively violent act because a private investigator hired by the Botes parents recovered just a few cheap trinkets and a cellphone from the three men who were arrested while trying to sell on the 'stolen goods'.
By August 12 2014, the close-knit Mahlangu tribal community -- where police believe he is hiding from justice -- has still not turned him over to the police for trial... The police even carried out raids amonst local tribal 'initiation schools' where the man reportedly had been hiding out, but the sangomas (witch doctors) whose premises were raided claimed that they had thrown him out 'because he had killed a baby."
Two years later, r, an identikit has been compiled from testimony by witnesses. The three arrested men deny that they killed the two Afrikaners. They merely took the stolen goods from the killer, it is being claimed.
The baby and his carer were murdered on a home at Geldenhuys Street, Delmas, in the home of the baby's parents Wiets (33) and Rita (32) Botes.
Private investigator Mike Bolhuis, who was appointed by the couple shortly after the gruesome double-murder, said 'it was so gruesome that the entire investigations- and forensic team was left deeply upset.'
"We have still not located the known suspect, Themba Ephraim Mahlangu. 29. We are asking anyone with information to contact us. He was last seen in Delmas.
People may contact Bolhuis at 082 447 6116 or the Delmas police at 012 808 1414."
Background:
On 21 May 2012, 5 month old Wiehan Botes was found strangled to death at his caretaker’s house in Delmas, South Africa.
The carer, Mrs Margrietha de Goede, 66 was also found strangled to death. While the details of their injuries have never been made public, they reportedly were 'gruesome'.
The hardened SAPS investigators and forensic team reportedly were traumatized by the gruesome scene.
Stolen were a few cheap items belonging to Mrs de Goede, including costume jewelry and a cellphone.
These stolen items however led to the three men fencing such goods by private investigator Bolhuis who was hired by the parents shortly after the double-murders.
He quickly apprehended the black men who were found in possession of the carer 's jewelry and admitted to receiving them from the alleged murderer. Two were named as Enock Mbele, 44, and Lazarus Mabhena, 54. They were denied bail when they appeared in court on 31 May 2012 in Delmas.
Their case is still pending and reportedly they have been in custody ever since.
Meanwhile the murder-suspect Themba Epharaim Mahlangu's compiled identikit is being distributed on the social media in South Africa at the moment in the hope that members from his own community will turn him in.
He was last seen in Delmas. The Mahlangus are a small, close-knit sub-tribe of the Zulus and historically have lived at homesteads in the greater Pretoria and
Magalies areas ever since the founding of the Boer republics. They are known for their geometric designs of their beaded jewellery and their painted thatched homesteads.
First report: "Baby, woman murdered at Delmas daycare"
2012-05-23 Cape Town - A caregiver and a 5-month-old baby boy were found murdered in Delmas, in Mpumalanga, police said on Wednesday.
The mother of the murdered baby had phoned Margrietha de Goede, 66, the caregiver, a few times to check on her child who was sick, but there was no answer.
The woman and a friend then went to the day mother's house, but became concerned when they heard a child crying.
They broke a window to gain entry to the house where they found an 18-month child, and called police when De Goede and the other baby, Wiehan Botes, could not be found.
Police arrived and made the grisly discovery of the Wiehan's body under a bed. Mrs De Goede, 66, was later found dead in a garden shed.
Police forensics officials were on the scene until after 18:00.

Background:
More than 5000 'white' (96 percent Afrikaans-speaking) farmers have been brutally murdered in South Africa since 1989. This is being recorded on archives maintained by the community on http://www.tlu.co.za, http://censorbugbear-reports.blogspot.com and http:www.censorbugbear.org/farmitracker reports, amongst many other online sites.
This is being done out of necessity because the ANC-regime has barred the use of demographic identifications in crime-reports in South Africa and is forcing the newspapers to adhere to this rule.
It has been recorded that since 1994, at least 60,000 white South Africans and many South African ethnic-European immigrants have been murdered by armed black-racist male gangs.
A great many of these crimes - primarily carried out by black male gangs - bear all the hallmarks of hatecrimes accompanied by excessive mental and physical cruelty: often family members are forced to watch while the victims are being murdered: often gang-raped and often tortured horribly before they are die or remain permanently traumatised and often disabled if they survive.
After the Botes/DeGoede double-murders, several Afrikaner-rights groups protested in Delmas (picture) against the senseless slaughter of white South Africans. They marched to the Police Station and handed over a memorandum to the Station Commissioner just a few days after the double-funeral.
The Democratic Alliance opposition party however condemned the Afrikaners' protest for its 'racial motivation'.
Since 1994, countless babies and young children have been murdered throughout South Africa. According to international crime statistics in 2011, South African children were being murdered at more than twice the rate of the world-average in any other country, including in war-zones. And while black communities often protest against the murders of children in their own communities, they continue to condemn protests by whites against the murders carried out by blacks against whites.
The ANC-regime officials hardly ever condemn the murders of 'whites' although we have recorded some official statements during their once annual "Campaign against violence against women and children' - apparently the only campaign when people may 'officially' demonstrate against the murders of children. Afrikaners are widely condemned whenever they try to demonstrate against the murders of their own children by blacks.

Double-murder trial of #Afrikaans farm-couple Van Heerden turned into a circus by 3 black suspects
3 black suspected double-killers of Van Heerden farm-couple turn Belfast murder trial into a joke, a circus:
---------------------
Aug 12 2014: Gerhard Rheeder of The Rekord daily in Belfast writes that the three double-murder accused suspects, Bongani Joseph Ncongwane, Irvin Brown Nkosi and Sibusiso Charles Sibanyoni are laughing, joking as the evidence of their gruesome torture-murders are coming to light.
The happy threesome are charged with strangling the elderly Afrikaans couple on 9 January 2013 and stuffing them in a freezer.
A trial-within-a-trial now has to decide whether Mrs van Heerden was still alive when they did so.
Picture ltr: Erupting with frequent laughter at their own trial are Bongani Jospeh Ncongwane (23), Irvin Brown Nkosi (19) and Sibusiso Charles Sibanyoni (27).
State-pathologist Dr Ferdinant Blok testified that Mrs Van Heerden was alive when she was dumped in the freezer.
The three happy suspects pleaded not guilty to all charges - but on Thursday Ncongwane admitted that the details he had pointed out and a statement he had to a senior police officer about the double murders, had been provided voluntarily.
The agreed that the documents and albums submitted to the trial can be used as evidence.
However accused Nkosi and Sibanyoni claimed they were 'threatened' by the police during their questioning - hence a trial-within-a-trial has to rule
whether the evidence is legally acceptable or not.
The State submitted that the police had found a Seko wrist watch belonging to the murdered farmer with one of the accused men's sister.
And Mrs Van Heerden's pistol, also stolen during the double-murder, was found with Nkosi when he was arrested for other violent crimes in Mamelodi.
During this arrest he had fallen off a high wall and these caused the bruises which the State believes Nkosi's defence council will use as 'evidence' that he had been beaten
by the police.
He had put up a fierce defence, shooting back at the police. The firearm he used in this firefight was traced back by the Mamelodi police to the murdered Mrs van Heerden.
When the elderly Afrikaner couple were found in their freezer, their necks were wound around with bonds and their arms and legs were tied up together.
It was noted by the journalist that the three suspects get loud verbal comments from two young girls in the gallery who are constantly calling out to the laughing and joking suspects in the dock as 'you f..g criminals'.
( It's not known why the magistrate does not order them to leave )
Meanwhile Nkosi was also jokes with two journalists from the Observer newspaper, showing handsigns and telling the journalists to 'make him famous'.
The trial continues with the three suspects getting a chance to testify about their version of events. http://www.rekordmoot.co.za

Murder trial against widow of Britstown farmer Nico Botha 60 after suicide-finding: De Aar
Is it murder or suicide? Months after the body of Nico Botha 60, boerbok-farmer of Britstown, was dug up, pathologist Dr Denise Lourens still doesn't know whether he was murdered or committed suicide: two shots were fired;
Trial resumes at De Aar, South Africa -- The State is going through considerable trouble trying to prove that widow Koekie, 64, murdered him:
DE AAR. South Africa– Months after the body of well-known Boerbok breeder Nico Botha (60)'s body was dug up, the State pathologist still cannot determine whether he was murdered or whether he committed suicide. The State is pulling out all the stops to try and prove that widow Koekie Botha killed him with two shots from a revolver. Initially his death in July 2010 was ruled a suicide. This week the 'murder-trial' of the widow resumed in the De Aar magistrate's court. Some family members have already testified on behalf of the State about the circumstances surrounding Botha's mystery-death on the farm Kareehoek near Britstown. On August 12 2014 testimony was heard by ballistics-expert warrantófficer Hermanus Dicks. He denied during cross-examination by defence counsel Advocate Johan van Niekerk, that he was 'throwing jackal-turns' during his cross-examination. Dicks testified that two shots were fired but that one could not have been a 'partial shot' when the weapon's barrel 's escaped gases would have made a black mark against the entry wound, depending on the distance from which the shot was fired. When fired from a longer distance the entry wound shows a 'fanshaped' burnmark. Dicks testified that he could not determine from which of the cylinders the projectiles were shot first. "If a person places the weapon against the first shot and fires again, there would have been blood on the front and sides of the revolver-barrel. Moreover the hand firing the weapon would have been spattered with blood unless the person wore gloves. Pathologist Denise Lourens, patoloog testified that she and other experts examining Mr Botha's skull, could not establish which of the two shots were fired first -- and thus could not say for certain whether Mr Botha had committed suicide, or whether he had been murdered. lik nie dadelik sy bewussyn verloor nie, en kon steeds beweeg, wat bloedmerke veroorsaak het.

Survives: Norman Hill, 73, attacked and stabbed in his East London home: shoots, injures one black male knifeman
Brave granddad fights off two young robbers Journalist Mamela Gowa
August 13, 2014 -- Stabbed, the white victim still manages to shoot one black male attacker.
A 73-yo East London grandfather bravely fought off two armed attackers a third of his age, shooting and wounding one in the process
Norman Hill of Greenfields was confronted by two men who forced their way into his house just after 8am while he was at home alone.
FEISTY: Norman Hill explains how he shot one of the two intruders who broke into his house and stabbed him in the hand during the struggle Picture: STEPHANIE LLOYD
Hill said the youths – whom he estimated to be in their 20s – opened the security gate at his kitchen door with a bolt cutter. On hearing the noise he went to investigate.“I asked who the hell was there but no one answered. When I got to the the door they did not even run away – they managed to cut the security gate and overpowered me after I smashed the gate against them,” he said.
The men demanded he hand over money and valuables.Hill – who lives in the house with his daughter and grandchild – said he wrestled with them all the way to his bedroom.
“They threatened to kill me by stabbing me,” he said. “One of them had a big knife but I kept fighting on until they hit me.”
He said they pushed him down onto the bed with such force that it broke. The heart patient said by this time he was exhausted from the struggle and the robbers started rummaging through his drawers and wardrobe, taking a plastic container with cosmetics and his binoculars.
He said they kept demanding he hand over a laptop “as if they knew there was a laptop” but he said he didn’t own one.
THEY KNEW THERE WAS A LAPTOP?
“They searched me and when they saw my car keys they threatened to take my car too but I had no intentions of giving up.” Thinking quickly, the elderly man told the men the valuables they were looking for were located in another room.
When they left him unattended Hill managed to open his safe and took out his pistol. He said one of the men rushed back into the room threatening to kill him.“I shot at him aiming at his shoulder and hit him. We started to wrestle soon after that, now fighting over my pistol.“Fighting for my life kept me going and I am actually glad that our strengths matched. I shot three more times; every time I felt like the gun was in line with his body but I kept on missing him until I fired the fifth shot and hit him in the stomach.”
The attacker dropped his knife and fled, leaving Hill with stab wounds to his hand and bruises on his body. The second suspect fled after Denley Boshoff – who rents a garden cottage from Hill – confronted the man on hearing the commotion from the main house.Despite suffering two gunshot wounds, the man who stabbed Hill escaped. Two cellphones were reported missing.“The police got here about 15 minutes after the incident.“They had all the relevant units attending to the scene. They gave me excellent service as they were very friendly, understanding and sympathetic.”
Police spokeswoman Warrant Officer Hazel Mqala confirmed the incident and said police were investigating a case of house robbery. “He was a true hero to defend himself like that and fight against youngsters,” she said.
“No arrests have been made yet, the suspects are both still at large and we are calling on anyone who could have information to contact the East London police because one of the suspects is out there wounded.” —

After one of the robbers grabbed this cellphone, car keys and R1200, the man was forced to the ground, kicked in the ribs and then dragged to the back of the store.
This can be seen on the video footage: https://www.youtube.com/watch?v=NPp3Uyl_vS8#t=35
The man, who asked not to be named, said: “We (including the Total employees) were told to lie down on the floor while they were busy getting into the till drawers and safe. After only a few minutes, which felt like a lifetime, there was a loud bang and smoke quickly filled the store.”
He said it took the robbers mere minutes to clear the tills and safe before fleeing the scene. “These guys mean business and would not think twice before taking your life,” he said.
MonitorNet arrived on the scene after they responded to a panic alarm triggered by one of the Total garage employees. When they arrived, the robbers opened fire and escaped with an undisclosed amount of money.
Theo Petzer, operational manager of MonitorNet, said two reaction vehicles were dispatched to the filling station. “Thankfully no one got hurt during the shooting.”
Captain Thomas Mufamadi, police spokesperson, said a similar robbery occurred at an Engen filing station around midnight on Sunday in Olievenhoutbosch. “The modus operandi was exactly the same. We are investigating whether or not both incidents were connected.”No arrests had been made by Monday afternoon.

Survived: ANC-mayor Salome Sithole of KwaGuga held hostage during rioting: locals demand more jobs from local mines
ANC-mayor Salome Sithole of KwaGuqa held hostage: rioters attack radio station where she spoke about complaints from local residents: the protestors demand that Ferromines give more jobs to locals --
Two vehicles damaged, two shops owned by foreigners looted, damaged: report by journalist: Solly Maseko -- 13 August 2014 -- A group of protesting job-seekers forced the executive mayor of "Emalahleni"- Cllr Salome Sithole, to flee from a radio station after being trapped on the premises of the municipality.
The ANC-mayor said she was unharmed but traumatised by the event.
The group of protesters said the mayor lied at the radio station and her statement angered them. They said a meeting with the mayor was scheduled for 10:00, but only took place at 13:00 after they allegedly stormed the council chamber.
The group was mainly protesting that the mines should be held accountable to employ more local people. Other issues raised were: learnerships, skills development, student bursaries, housing allocation, tendering in the mines, SMMEs and the mines’ procurement processes and their databases.
MAYOR LIED TO US:
“We were surprised that she was in a meeting with councillors and mine representatives discussing our issues without us. She deliberately applied delaying tactics, after that she went on air talking about issues without our mandate. She was hijacking the whole process and wanting all the glory. This is about us and the mine representative, she is only acting as a mediate.”
The group further said they are "not fighting with councillors and are not political motivated". Their concern is the welfare of the people of eMalahleni.
CITY ADMINISTRATOR THEO VAN VUUREN SPOKE TO PROTESTORS:
After the drama at the radio station on Monday, city administrator Mr Theo Van Vuuren arrived and addressed the people. He said in a meeting facilitated by the municipality on Monday the mentioned issues were raised. Van Vuuren said that community members indicated their frustration that these issues are not receiving attention. For three days KwaGuqa was engulfed in fire as some members of the community were protesting. On Thursday morning, August 7 some people woke up to find that main roads were blocked with burning tyres and rocks and some were prevented from going to work.
Busses carrying workers were prevented from entering and leaving the area. Some workers were ready for work, but stood in groups on street corners waiting for their transport. A bus and two taxis were also stoned.
At the entrance from Ferrobank’s side, protesters had a running battle with the police as they demonstrated and blocked the road. Rubber bullets were fired and protesters fled the scene.Burning tyre barricades were also thrown up around the SANTA (TB) hospital. On Friday at about 02:00 the crowd regrouped and blocked the road as the previous day. Four rooms at a hostel in Ackerville were allegedly burned by the group and a hostel dweller was assaulted.
The community indicated their frustration that their issues are not receiving attention, resulting in local people not sufficiently empowered and employed.“We need the mines to recognise that there are different categories of people within our community, skilled and non-skilled. The mines must come out clear about how they hope to develop skills of our people. Presently they employ about 30% and outsource 70% – we want to change that. They need to employ 70% local people and outsource 30%. They need also to come out clear about their social development plan and their social labour plan. We need transparency about their plans. We need transparency on how they spend their budget on community projects.”
The group wants to have representatives on mine recruitment committees, who should report back to community forums.“A process of engagement with the mines and other industries has been agreed upon in principle to seek joint sustainable solutions to issues raised. However the events of last night (Monday night at the radio station) show that there is a high level of frustration on these issues making the process going forward difficult. However, the municipality and mines have committed themselves to continue working towards a solution,” said Van Vuuren.
“The police are on standby and will act as may be required. Everyone is cautioned to be on the alert and to be careful. I have also withdrawn municipal teams from the area and we are experiencing backlogs been formed on electricity, water and waste issues as a result. The matter has been escalated to the highest levels for support to be resolved. For those affected by these events please remain calm and be assured that as municipality we will try to work out a solution for both short and the longer term issues at stake,” said Van Vuuren.
Police reported that two vehicles were reportedly damaged and two foreign shops were looted and damaged.
The Democratic Alliance (DA) also responded to the unrest.
“It has come to the attention of the DA that the violent protests in Ackerville, that took place on Thursday and Friday are as a result of the community allegedly being unhappy over recruitment processes in the greater Witbank mining area.
“Furthermore, it is alleged that a group called ‘the Concerned Group’ convened a meeting during the past few days wherein the decision to blockade all main access roads in Ackerville was taken. This matter has unfortunately led to unruly protests and at 04:00 all entrance and exit routes to Ackerville were blocked, rubbish bins upended and tyres burnt in the streets.
“It is unfortunate that as a result of this protest, violence was threatened and people were prevented from reaching their place of work. People have the right to strike, but violence cannot be tolerated. In the face of the current unemployment rate, job losses cannot be tolerated.
“The DA would like to commend the SAPS on their swift action in attending to this unfortunate incident. We trust that they will keep up with their strong vigilance in this area.”

Survives: Unnamed white woman , 56, attacked at home: cut in face, breasts, legs, body by unknown black male in orange overalls
Survives: white Witbank woman, 56, cut in the face, breasts, legs and body by unknown black male in orange overalls (pictures of injuries)
Journalist Corlia Kruger writes in the Witbank looklocal weekly that the unnamed victim of an attack at her Reynorif home Sunday 3 August, has blocked out the ordeal which left her face, legs and body bruised and covered in scrapes.
"I really can't remember much, she said, rubbing the marks beneath her neck.
She said she was attacked in the living room. "I heard a thud above the room, and then a second thud."
She went upstairs on the second floor to investigate and ran into an unknown black male who very likely broke into her home through the small bathroom window.
She thinks he was working with an accomplice. "He grabbed me, held my hands behind my back with one hand, while covering my mouth with the other hand.
After that moment the memories are vague, she does recall he cut her with a knife. "I think he tried to rape me,' she said, describing that her slacks and legs were cut.
"I must have passed out or must have blocked it out... ". The cuts across her legs and chest tell the story of the cruel attack, writes Kruger.
"One cannot think clearly at such a moment, I told myself to scream but not one sound came out,'she said, shaking her head.
Her son who lives in the cottage next to hers at that moment stopped by to see if she was allright. "The gate makes a lot of noise when it's opened, and the attacker then just grabbed ' little 'items and fled by squeezing through the bathroom window.
He took her keys to the car but fled without her car. She tries to remember what he looked like: sort of tall and yellowish wearing orange overalls.
The knife she was cut with was found next to a tree on their erf. She's still scared after the attack.

Survived 3 bullets: Retired SAPS colonel Stoney Steenkamp, shot 3 times by armed robbers
Injured: Retired SAPS col Stoney Steenkamp, shot three timesd by armed gang #Witbank Highland Mews
http://witbanknews.co.za/22678/retired-cop-shot/
13 August 2014 Picture: Paramedics from Langamed Emergency Management Service make their way out of Highland Mews with retired SAPS colonel Stoney Steenkamp on a stretcher.
The shooting took place on August 11 at Highland Mews, in front of Clicks.
Walking towards the north-western entrance of Highland Mews all one could see was the blue and yellow markings of police vehicles, as police cordoned off the road with orange cones.
Moments later the doors which were once barred opened, and paramedics from Langamed Emergency Management Services came walking out pushing a self loading stretcher along. Steenkamp lay on it in a stable state, smiling all the while, knowing he had survived the ordeal of being shot at least three times.
Every Monday morning Steenkamp would make his way from the church to bank the church’s money. That Monday, he parked his car at the north-eastern entrance and walked into Highland Mews. As he approached the entrance to Clicks two men approached him.
“One was short, the other tall, one had a red sweater and the other wore a yellow one, both had guns,” said one of the stall owners who witnessed the shooting.
The robbers drew their guns and the stall owner immediately lay on the floor in fear of her life.
“I could see and hear everything, one of the men demanded that the old man hand over the bag but he refused, they began shooting off shots to scare the old man but he didn’t budge,” continued the stall owner.
Three warning shots were fired at Steenkamp’s feet. The robbers grew tired of Steenkamp’s refusal to hand over the bag and shot him three times.
Another witness, known as Nico, was in Musica at the time. When he walked out he heard the gunshots and quickly backtracked, he saw the two robbers run past the front of the store and made his way out to offer help to Steenkamp who stood in the doorway of Clicks, bleeding from his wounds.
At the time of the shooting the nurse working at the clinic in Clicks overheard the gunshots and made her way to the front of the store where she met Nico. The two of them helped move Steenkamp to the clinic.
“I called the ambulance and we did what we could to stop the heavy bleeding from his leg,” said the nurse. She added that "he looked pale" and she kept reassuring him that everything would be fine.
“They shot him three times, there was one shot in his right foot, it went straight through. They also shot him in the upper left thigh, the bullet exited in his lower thigh and the last shot was fired into his upper left calf,” said Nico.
Another witness strongly believes that the robbers were given the information that Steenkamp would be banking money that morning.
The robbers fled the scene in what was believed to be an Audi A4. “It is a sad incident and we don’t want our clients to be fearful, we are glad he is okay,” said Ms Annamrie Janse van Vuuren, Highland Mews management.
Forensic examiners at the scene confirmed that six shots were fired. The area was tidied up and the bloodied floors disinfected and mopped clean, all the while one of the staff members of Clicks added that Steenkamp was smiling as he was being pushed out towards the ambulance.
Steenkamp was transported to Life Cosmos Hospital where he underwent a CT scan on Tuesday and his surgery was planned for Thursday. Despite his injuries Steenkamp is in good spirits and good condition.
*In an armed robbery on June 3, a man was on his way to deposit a sum of money at a bank in Saveways Crescent Shopping Centre. He too was shot in the leg by two men, who fled in an Audi A4 that has matching licence plates to the Audi A4 used in the robbery in Highland Mews. Police believe the two suspects are using the same modus operandi.
*Nico and other witnesses’ names were withheld to protect their identities.

Huge #landgrab in Philippi East despite Constitutional Court order 7 August 2014 ruling against 'Marikana Land Invaders'
#LandGrab - Large-scale land invasion in Philippi East, Cape Flats reports councillor JP Smith
The Constitutional Court on 7 August 2014 delivered judgment in the City's favour in the Erf 150 Philippi East matter (ala as the "Marikana' land invasion case").
The Court the applicants' (li.e. the and invaders') leave to appeal against the decision of the Supreme Court of Appeal -- because the application bore no prospects of success.
==========
13 August 2014 " JP Smith says hundreds of unoccupied structures have been erected or are in the process of being erected
Cape Town cannot afford or tolerate large-scale land invasions. " The City of Cape Town condemns the large-scale, orchestrated and damaging land invasion currently underway on privately-owned land in Philippi East.
This land-grab holds the potential to be of an unprecedented scale. The City, with our law enforcement agencies and the South African Police Service (SAPS), will continue to do everything in our power to contain the situation.
Every city in South Africa acts to protect land from invasion. It is their constitutional duty, but the obligation to protect land from invasion is also borne from practical considerations.
Invaded land immediately becomes a fire and flood risk. If land such as this is illegally occupied, the economic and job creation opportunities that would be created if industry could be established there, are lost and it condemns these residents to live in areas with little access to jobs and economic opportunities.
Various court orders have been obtained by the land owners interdicting people from erecting structures on the erven in question.
The City and one of the land owners also has an interdict in place pertaining to one of the pieces of land, Erf 150, to support the elderly land-owner whose land has already been illegally occupied in the past.
Concerning this land, the Constitutional Court on 7 August 2014 delivered judgment in the City's favour in the Erf 150 Philippi East matter (also commonly referred to as the ‘Marikana' land invasion case).
It dismissed the applicants' (land invaders) leave to appeal against the decision of the Supreme Court of Appeal because the application bore no prospects of success.
The Supreme Court of Appeal had in May 2014 overturned the incorrect findings of Judge Gamble of the High Court in Cape Town that the City had acted unlawfully when it had removed structures erected on Erf 150.
The City has been vindicated by the Supreme Court of Appeal and the Constitutional Court that its actions in protecting private property from land invaders is compliant with its constitutional obligations.
The City will continue the implementation of its housing and service delivery programmes.
With the highest urbanisation rate in the country, it is imperative that we uphold a fair and equitable system of delivering and accelerating the provision of housing opportunities and other services to those in need and to our most vulnerable residents.
The City will continue to uphold the values contained in the Constitution. This includes respect for the dignity of all, compliance with the rule of law at all times, and preventing queue-jumping by those who illegally invade land.
We must continue to protect a fair and systematic housing delivery process.
Order of events
The Sheriff of the Court served the interim High Court interdict on 8 August 2014 on the unlawful occupants on erf 149 RE, Philippi. The SAPS requested the assistance of Law Enforcement to serve the court order on Friday.
Over the weekend, a large-scale land invasion became evident.
On Monday, Law Enforcement did not remove anyone. Instead, they were preventing further invasion of the land since all individuals invading the land were in contempt of the High Court order obtained by the private land owner on Friday.
Only uncompleted and vacant structures were removed.
Furthermore, Law Enforcement tried to prevent the offloading of building material, which had arrived en masse, by a torrent of trucks. This process could not be completed because Law Enforcement was attacked by the unlawful occupants and pelted with stones.
Hundreds of unoccupied structures have been erected or are in the process of being erected.
The SAPS as well as Metro Police, Law Enforcement and Traffic Services are currently on the ground and doing everything in their power to contain the situation, which remains volatile.
Law Enforcement is dismantling unoccupied structures that were put up yesterday. They will be dismantling hundreds of unoccupied structures today.
It must be noted that there has been a concerted effort to invade both private and public land across the City of Cape Town as a means to promote lawlessness and in an attempt to make the city ungovernable.
We believe that the situation playing out in Philippi East is an example of these determined efforts to promote the illegal occupation of land for political objectives.
We condemn in the strongest possible terms the actions of those who are instigating communities for their own political and monetary gain.
We furthermore condemn the violence that has been associated with this situation.
Cape Town simply cannot afford or tolerate large-scale land invasions.
Statement issued by Alderman JP Smith, Mayoral Committee Member for Safety and Security, City of Cape Town, August 13 2014
