Afrikaner rape-victim Lindsay Pistorius 39, sues #SouthAfrica police and prison-service at #PretoriaHighCourt for poor service delivery: Mrs Lindsay Pistorius 39, pharmacy-assistant, is suing the SAPS and the prison service in the Pretoria High Court for their poor service-delivery after she was raped in July 2010 by convicted rapist Elias Mothate in her Orchards, Pretoria home in July 2010. Her seven-year-old son was present that night when Mothate assaulted her with a pitch-fork, raped her and then kidnapped her in her own car. She was so seriously injured that she needed a month in hospital to recover. He was found guilty and serving a life-sentence. However, Mrs Pistorius says in her law-suit that the police failed in their duties when they did not initially investigate the case properly. "Only two weeks after my discharge from hospital did the Akasia SAPS send someone to take my statement. They did not examine objects at the crime scene with gloves on. They grabbed the pitchfork I was assaulted with, and threw it with their bare hands into the police vehicle's boot. They took no semen-samples nor any finger-prints at the crime scene. They police ripped out the car-radio in my vehicle in which I was kidnapped, damaging it." Mothate also was released into the community while he was awaiting bail-application in my case, and while he was awaiting his trial for a similar case in the Brits magistrate's court. In addition he was also out on parole already for armed robberies he had carried out while also raping his victims'. She is also suing the State for her child's emotional trauma: the borgtog vrygelaat en verhoorafwagtend was kragtens ’n soortgelyke saak in die landdroshof in Brits.
The prison department and the South African Police Department deny the claims and say they will contest the law-suit which starts in February 2015 in the Pretoria High Court.
